LOMA's Privacy Policy

LOMA is committed to maintaining your confidence and trust, and accordingly maintains the following privacy policy to protect personally-identifiable information that we collect from you as you use these websites (the "Sites"). By submitting information, you agree to LOMA's use of such information as described in this document.

What information does LOMA collect?

LOMA collects personally-identifiable information (such as your name and email address) at certain points on our Sites—for example, when you complete registration/subscription data for services or sections of our Sites requiring such information, purchase or take a course, fill out a survey, enter a contest or sweepstakes, or complete other interactions or transactions through the Sites. The personally-identifiable information collected may consist of a unique access ID, company affiliation, title, and contact information, such as name, mailing address, email address, and telephone and fax number, areas of interest, and any other personally available information you provide. LOMA also collects billing information, including credit card numbers and expiration dates, from visitors who pay or register for LOMA products and services online.

LOMA logs visitors' IP addresses for the collection of aggregate information about site visitors and their interests. For example, in tracking information about the visits to our Sites, we compile statistics that show the daily number of visitors to our Site, the daily requests we receive for particular files on our Web Sites, and what countries those requests come from. These aggregated statistics are used internally to better provide services to our customers and may also be provided to others (such as banner advertisers). LOMA's learning management system (LMS) maintains detailed individual access records, to enhance security and to meet compliance audit requirements.

LOMA may place a "cookie" on the visitor's hard drive in order to facilitate a user-friendly experience while users are on the Sites. Cookies are small files that contain information a Web site uses for tracking purposes. LOMA uses cookies to help track who you are when you log on to any of our Sites. When users log on, a cookie is set; when they log off, some cookies are deleted. Other cookies known as “persistent cookies” are placed in visitor’s temporary Internet files in order to maintain e-commerce functions across multiple browsing sessions. LOMA uses the cookie information we receive to improve the efficiency of our customer service. LOMA may also use cookies to enhance site content by compiling aggregate information about what specific sections and pages users visit. Except as provided in this Privacy Policy, LOMA does not collect or make information obtained about any individual users available to third parties.

LOMA does not direct any of our content to children under the age of 13 and no part of these Sites is structured to attract anyone under 13. We do not knowingly collect or use personally-identifiable information from children under 13. If we learn that a user is under 13 years of age, we will promptly delete any personally-identifiable information we have collected about that user. If you are under the age of 13, please do not send us any information about yourself.

How is the information used?

LOMA uses your personally-identifiable information to fulfill your requests for information and to process your requests to register for and take courses. LOMA may also use personally-identifiable information to perform statistical analyses of user behavior in order to measure interest in specific areas and courses available through our Sites. The email addresses provided at registration allow LOMA to send email to individuals based on the areas of interest that they have indicated in their user profile.

LOMA may use your information in the aggregate for marketing and promotional purposes. We may also use your information to improve the content of our Site, to notify you about updates to the Site, and to contact you for marketing purposes. LOMA never shares personally-identifiable information with anyone not in a business relationship with our organization. LOMA may also provide contact information in connection with LOMA meetings to organizations that work with LOMA. The use of this information is limited to contact in connection with the LOMA meeting. Out of respect for the privacy of our users, we present the option to not receive these types of communications by providing an opportunity to “opt-out” of any contact based on this information.

Like most organizations, we do provide LOMA conference participants with a list of attendees and contact information for conferences they attended.

LOMA may occasionally inform users and newsletter subscribers about special offers, new courses or other products, and other third-party product and service offers that we believe they will find useful or interesting. LOMA registered users and newsletter subscribers are given the option to choose whether they would like to receive such mailings. At any time, you can request that your information not be used for such purposes by sending an email request to LOMA at askloma@loma.org, using the header “Opt-out.”

Registration

In order to access certain restricted portions of our Sites, such as Members-Only content contained on the LOMA Web site and certain portions LOMA's LMS, a user must complete a registration form. During registration, users are required to give their contact information (such as name and email address). Users are also requested to provide specific demographic information needed by LOMA so that we can better meet customers' needs. This information is used to contact the user about the services on the LOMA Sites for which they have expressed interest and to ensure that only authorized users of the LOMA Sites have access to the secure parts of the Sites. For example, we may send all new registered users a welcoming email to verify password and user name. Established users may also receive information on products, services, special offers, and a newsletter.

Who can see my information?

LOMA is the sole owner of the information collected on the LOMA Sites. We do not sell, share, or rent this information to others in ways different from what is disclosed in this statement. LOMA does not intentionally disclose (and shall take reasonable steps to prevent the accidental disclosure of) your personally-identifiable information to third parties (e.g., persons or entities not associated with LOMA), whether for such third parties' marketing purposes or otherwise, subject to the following exceptions:

  • LOMA may disclose your personally-identifiable information to third parties as required or permitted by the laws, rules, and regulations of any nation, state, province, or other applicable jurisdiction;
  • LOMA may disclose your personally-identifiable information to third parties who deliver information from us to you for the purpose of performing such delivery;
  • LOMA may share personally-identifiable information with third party intermediaries, such as credit card companies and banks, for the purpose of conducting online purchase transactions;
  • LOMA may disclose your personally-identifiable information if, in connection with submitting the information, you consent to such disclosure;
  • LOMA may disclose your contact information in response to inquiries by bona-fide rights owners in connection with allegations of infringement of copyright or other proprietary rights arising from information you have posted on the Sites or otherwise provided to LOMA;
  • If LOMA merges with or transfers substantially all of its assets to a third party, information collected by LOMA may be disclosed to and owned by the merged entity or third party.

Security

LOMA has implemented generally accepted standards of technology and operational security in order to protect personally-identifiable information from loss, misuse, alteration, or destruction. Internally, LOMA restricts access to personally-identifiable information to those employees who need the information in order to do their jobs. These employees are limited in number, and are required to treat this information as confidential. Your credit card information is encrypted for security. Our ordering process is protected by the Secure Sockets Layer (SSL) protocol, which encrypts your information and confirms the identity of the LOMA server during your shopping cart purchase process. Credit card information is maintained only for the duration of a transaction, and is not stored within LOMA. Despite these precautions, LOMA cannot guarantee that unauthorized persons will not obtain access to your personally-identifiable information.

Links to other sites

LOMA may provide links to third-party Web sites as a service to our users. In addition, some of the content appearing to be on the LOMA Sites may be in fact supplied by third parties, for example, in instances where we open frames to third-party Web sites or incorporation through of content supplied by third-party servers. Please be aware that we cannot control and are not responsible for the information collection practices of such third-party Web sites, which may differ from those of these Sites. We encourage our users to be aware when they leave our Sites and to read the privacy statements of each and every Web site that collects personally identifiable information. This privacy statement applies solely to information collected by LOMA Sites.

How can I access, change, and/or delete information?

You may access, correct, update, and/or delete any personally-identifiable information that you have submitted to the Sites. You may also unsubscribe from mailing lists or any registrations on the Site. To do so, please either follow instructions on the page of the Site on which you have provided such information or subscribed or registered, or send an email to askloma@loma.org.

Transborder hosting, processing, and transfer of information

Personally-identifiable information collected on these Sites may be transferred from time to time to LOMA offices or to associated businesses located in other parts of the world, including locations outside North America. Furthermore, the Sites may be viewed and hosted anywhere in the world, including countries that may not have laws regulating the use and transfer of personally-identifiable data. Regardless of your location, including if you are located in Canada or one of the member states of the European Union, by using the LOMA Sites and submitting such information on them, you voluntarily and unambiguously consent to the collection, use, and processing of this information in the United States and to the transborder collection, transfer, use, processing, and hosting of such information anywhere in the world.

Consent

By using the Site, you unambiguously consent to the collection, use, and storage of your information by us in the manner described in this Privacy Policy and elsewhere on the Sites. We reserve the right to make changes to this Privacy Policy from time to time. If LOMA plans to use information collected from users in a manner different from that stated at the time of collection, we will directly contact users to obtain written or active email consent prior to using their personal information. LOMA may also post a notice on the Sites to obtain user consent. We will also alert you to any such changes by updating this Privacy Policy.

Canadian Anti-Spam Legislation

If you have voluntarily provided personally identifiable information (including name, company, email address, and specific demographic data), you have assumed an implied business relationship with LOMA and therefore consent to the collection, use and disclosure of your personally identifiable information as described in this privacy policy. LOMA will not use personally identifiable information for any purpose outside of the implied business relationship.

In order to achieve the goals of the anti-spam legislation, LOMA will ensure to act in compliance with Canada’s Anti-Spam Legislation. In order to ensure compliance, commercial electronic messages (including email marketing) will be based on an “Opt-In” approach. LOMA will gain consent for commercial electronic messages purposes prior to sending commercial messages (including emails), unless we have a pre-existing business relationship with the client as in these particular cases consent is considered to be implied. Should LOMA require personal information for a new purpose, we will contact you to seek consent for that new use. Individuals that “Opt-Out” from receiving emails from our company will be unsubscribed upon that request. This is in accordance with Canada’s Anti-Spam Law (CASL) effective July 1, 2017.
